These Terms and Conditions (“Terms”) govern your use of coolcard.org (“Cool Card,” “we,” “us,” or “our”). By accessing or using the service, you agree to these Terms.

Use of the Service

You agree to use Cool Card only for lawful purposes and in compliance with these Terms. You must not use the service in any way that violates applicable laws or regulations.

User Content

Cool Card allows you to upload images, text, and other content (“User Content”) to create cards. You retain ownership of your User Content.

By uploading content, you grant Cool Card a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and display your content as necessary to operate and improve the service.

You represent and warrant that you have all necessary rights, permissions, and consents to upload and use your content, including rights related to intellectual property, privacy, and publicity.

Prohibited Content

You agree not to upload or create content that:

• Infringes intellectual property rights
• Violates privacy or publicity rights
• Is unlawful, harmful, abusive, defamatory, or misleading
• Impersonates another person or entity

Intellectual Property

Cool Card and its website, software, templates, branding, and design elements are owned by Cool Card or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or exploit any part of the service except as permitted by law or with our written permission.

Generated Content

Cards generated through Cool Card may include both your User Content and our templates or design elements. You may use generated cards for personal use, provided you have the necessary rights to the content you supplied.

Cool Card retains all rights to its templates, design systems, and underlying technology.

Accounts

If accounts are offered, you are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

Termination

We may suspend or terminate your access to the service at any time, without notice, if you violate these Terms or misuse the service.

Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Cool Card shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or use arising out of or related to your use of the service.

Indemnification

You agree to indemnify and hold harmless Cool Card and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the service or violation of these Terms.

Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the United States and the applicable laws of your jurisdiction, without regard to conflict of law principles.
